SCOTUS Hearing on MS Abortion Ban Highlights the Damage Done by Right’s Court Packing

Washington, DC — Today, President of the American Constitution Society Russ Feingold released the following statement on the Supreme Court’s hearing on the consequential abortion rights case Dobbs v. Jackson Women’s Health Organization.
"It is unconscionable that today, in 2021, the Supreme Court is poised to wipe away fifty years of women’s empowerment and rights and return to the days when the state could make pregnant people prisoners in their own bodies, forcing them to carry out the wishes of the state. The only reason we are here, where we fear the Supreme Court taking away a constitutional right, is because of the Right’s packing of the Court. If not for such court packing, we would almost certainly not face this very grim reality where abortion access could soon be taken away from millions and millions of people. The Supreme Court’s credibility is already in peril. Overturning Roe will confirm that this conservative supermajority is driven not by law or precedent, but by a naked partisan agenda.”
