Washington, DC – In response to the Supreme Court’s 7-2 decision in Haaland v. Brackeen, the American Constitution Society released the following statement:
“ACS welcomes the Supreme Court’s decision upholding the Indian Child Welfare Act (ICWA) and Congress’s authority to enact it. This decision is an enormous and important win for Tribal sovereignty,” said ACS President Russ Feingold. “ICWA remains as vital today as it was when it was enacted 45 years ago to address the government’s widespread discriminatory removal of Native children from their families and their tribes. We celebrate today’s decision while recognizing that the fight to preserve Tribal sovereignty must and will continue.”
