Can a Dead Constitution Bind the Living?
Ilan Wurman, visiting assistant professor, Sandra Day O’Connor College of Law at Arizona State University, is the author of “A Debt Against the Living: An Introduction to Originalism” (Cambridge 2017). He will be discussing his book, where he introduces James Madison’s concept of originalism and how it has shaped the U.S. Supreme Court in ways that are expected to continue following the death of Justice Antonin Scalia. one of the theory’s leading proponents.
Frank Bowman, Floyd R. Gibson Missouri Endowed Professor of Law, will argue the “living breathing” interpretation of the constitution.
