The Capitol Riot and the Constitution: What Comes Next?
Several constitutional questions have been raised in the aftermath of January 6, when rioters breached the Capitol building and halted the constitutionally required electoral college certification process. Members of Congress were forced to evacuate the Capitol as rioters occupied the building and violence and destruction ensued for hours.Â
Some of these questions center around whether the former President was responsible for inciting the lawless action that followed his speech that day, while some others center around whether he had a duty to intervene and put a stop to the chaos.
